Amendments to legislation in the field of intellectual property were signed

On June 20, 2018 the Head of State signed the Law of the Republic of Kazakhstan “On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Improving Legislation in the Sphere of Intellectual Property”.

The Law introduces changes and additions to a number of legislative acts and is aimed at improving legislation in the field of intellectual property, simplifying the procedure for registering its facilities, eliminating legal gaps, and excluding the norms that create administrative barriers in the field of intellectual property protection.

A new provision on mandatory publication of applications for trademarks is introduced from the moment they are received by the expert organization.

The legislative act introduces the institution of compensation instead of compensation for damage in violation of the trademark rights. It is proposed to determine the amount of compensation established by the court, which the right holder is entitled to demand in exchange for compensation for damage in cases of violation of his rights, based on the nature of the violation, the market value of homogeneous goods.
