Please be informed that on April 19, 2023 an online meeting dedicated to the discussion of current IP and Tax Issues in Kazakhstan was held for EUROBAK member companies.
It is well known that the tax authorities pay close attention to transactions involving the provision of technical services when carrying out tax control. Most often such services are provided under a contract which also covers the granting of the right to use intellectual property items.
Under international taxation rules, there is a fundamental difference between the taxation of royalties and payments for technical services. Therefore, the re-assessment by taxpayers of payments for technical services as royalties results in additional taxes.
Proper registration of rights to the intellectual property items saves money by deducting certain expenses for activities aimed at maintaining and/or increasing the volume of sales of goods regardless of the existence of ownership rights to them.
In this regard, the following issues were discussed during the online meeting:
– What is the court practice in Kazakhstan;
– How to minimize the risks of additional taxes;
– What should be taken into account when making payments and whether it is possible to enter IPRs on the balance sheet and amortize their value?
