Remuneration to performers and authors for sound recordings
Minister of Justice of the Republic of Kazakhstan by the Order dated 22 June 2023 approved the minimum rates of remuneration to performers and producers of sound recordings reports Zakon.kz.
For use of performances and sound recordings through public performance, display, communication and bringing to the public’s attention the rates are set as follows:
- Cafes, bars (per month per seat) if entrance is paid 0.2 monthly calculation ratio (MCR) that is (690 KZT in 2023), if free entrance then 0.1 MRC (345 KZT).
- Restaurants (per month per seat) – if paid entrance 0.25 MCR (862.5 KZT), if free entrance – 0.15 MCR (517.5 KZT).
- Nightclubs (per month per seat) – if entrance is paid – 1 per cent of ticket sales revenue, if free admission – 0.2 MCR.
- Casinos and other gambling establishments (per month per seat) – 0.4 MCR (1380 KZT).
- Cultural and entertainment centers, complexes (per month for each square meter of sounding area) – 0.05 MCR (172.5 KZT).
- Sports and recreation centers, complexes (per month for each square meter of sounding area) – if paid entrance – 0.01 MCR (34.5 KZT), if free entrance – 0.001 MCR (3.45 KZT).
- Fairs, exhibitions, fashion shows, beauty and professional contests (per month for each square meter of sounding area) – 0.02 (69 KZT) and 0.002 MCR (6.9 KZT), respectively.
- Hotels, resorts, rest houses and boarding houses (per month per unit of technical means used for public performance, display and communication) – 0.16 MCR (55.2 KZT).
- Passenger transport (on the income received from the sale of each ticket) – 0.001 MCR.
- Places for mass skating, roller skating (per month for each square meter of premises (territory) used for these purposes) – 0.05 MCR if paid entrance, if free entrance – 0.01 MCR.
- Theatres, cinema halls and other places intended for demonstration of films (per month for each square meter of sounded premises) – 0.01 and 0.001 MCR, respectively.
- Trade houses, shops, trade markets and other places intended for trading purposes (per month for each square meter of sounding area) – 0.002 MCR (6.9 KZT).
The Order shall be in force from 10 July 2023.
