Bolotov & Partners team won a court dispute related to protecting a client’s rights. Our client is a Eurasian patent owner for a pharmaceutical invention. This invention relates to the field of medicines and methods of medical treatment of one of the severe rare disorders. The opponents tried to challenge the patent, claiming that it does not possess such a condition of patentability as novelty. Despite their active attempts and attraction of experts/specialists, opponents were unsuccessful in challenging the patent.
From the beginning our strategy was to protect the patent comprehensively. We prepared our materials thoroughly, using both legal expertise and careful analysis of technical aspects, as well as involving independent experts on our side as well. The Eurasian Patent Office, which issued the patent, played an important role in the court proceedings and took our side.
As a result, the court confirmed the validity of the patent, recognizing its patentability.
This victory not only preserved our client’s legal rights, but also strengthened our clients’ confidence in the Eurasian patent system.
