As we informed you before, On February 8, 2024 the Order of the Minister of Justice amended the Rules for Examination of Applications for Trademarks, Service Marks, Geographical Indications and Appellations of Origin. It is now possible to request an accelerated examination of trademark applications.

If the usual procedure for registering a mark takes approximately eight months, then with an accelerated examination, registration will take approximately four months. We remind you that a request to accelerate the examination is submitted together with and no later than the filing of the application. Payment for acceleration is also made immediately upon submission of the application.

The official fees for conducting the accelerated examination have been approved only on April 10, 2024.

Filing and expedited examination of a trademark application up to three IC will cost US $1,556, each additional Class over the third will be charged by US $480.

It is necessary to take into account that during expedited examination conventional applications are not taken into account. And if after registration of a trademark through an accelerated examination it is discovered that there is an earlier priority application, the trademark will be cancelled. Note that the amount paid by the applicant for expedited examination is not refunded.

Attachment to the Order contains a form of request for accelerated examination, in which the applicant confirms that “the applicant is aware of the possible cancellation of a trademark registration, in the case of an application under convention, exhibition and (or) other priority”.
